COBRA Administration Services

Compliance– the right way, the first time.

State and Federal laws require compliance with Consolidated Omnibus Budget Reconciliation Act of 1986 (COBRA) and the Health Insurance Portability and Accountability Act of 1996 (HIPAA) regulations. COBRA outlines how employees and family members may elect continuation coverage and requires employers and plans to provide notice. HIPAA Certificates of Creditable Coverage must be sent to all employees and family members losing insurance coverage.

Compliance can be complicated and time-consuming. And failing to comply with the COBRA/HIPAA rules set forth by the Internal Revenue Service and Department of Labor can be costly ($100 per day with a maximum of more than $100,000 per qualified beneficiary). When dealing with disgruntled employees and their spouses, the process can be even more daunting. This is where S&A steps in to manage all facets of your COBRA/HIPAA administration, so you don’t have to.

S&A’s COBRA administration and compliance services include:

  • Premium payment tracking with easy-to-use payment schedules and coupon books;
  • Tracking of qualifying events and COBRA notices to ensure compliance;
  • HIPAA Certificate preparation for proof of continuity of insurance coverage;
  • One-on-one consultation and support for participants;
  • Coordination with the insurance broker, if desired;
  • Consistent communication and reporting for clients; and
  • Access to an ERISA attorney.

are you cobra compliant?

  • Do you provide a COBRA Initial Notice? Do you know all of the Terms and Reasons for them?
  • Do you send out letters to spouses and/or eligible dependents?
  • Do you know there is an extended payment time? It doesn’t have to be the same time frame as the election!
  • Improperly worded Notices/Letters can be construed as a “Failure to Notify”.
  • Do you offer Health Insurance? Dental? Flex Spending? HRA? Vision? These, too, are COBRA-eligible.
